【签订地点】利马 【签订日期】19980914 【生效日期】19980914 【有效期限】 交水发(1998)609号 全文 中华人民共和国政府和秘鲁共和国政府,为了促进两国间的友好关系,发展双边贸易,加强海运合作,按照平等互利的原则,达成协议如下: 第一条 在本协定中, 一、“缔约双方”系指中华人民共和国政府和秘鲁共和国政府。 二、“船舶”系指在缔约一方登记并悬挂该国国旗的商船,包括缔约一方航运企业租用或经营的悬挂为缔约另一方接受的第三国国旗的商船,但不包括军用船舶和其他非商业性船舶。 三、“船员”系指航次中在缔约一方船上或在缔约一方航运企业按照本协定范围租用或经营的悬挂第三国国旗的船上服务,持有本协定第八条所指身份证件,并列入该船船员名单的船长和其他人员。 四、“航运企业”系指按照缔约一方立法在该方境内注册并获准从事国际海洋运输的法人。 五、“沿海运输”系指缔约一方根据本国立法在该国港口之间进行的海上运输。 第二条 一、缔约双方的船舶可以往来于两国对外国船舶开放的通商港口,运输两国之间或缔约任何一方与第三国之间的货物和旅客。 二、本条第一款的规定不影响第三国的商船参加该款提及的运输。 第三条 缔约双方应在发展双方海运关系,遵循公平竞争和国际航运自由原则的基础上,制止任何有碍正常国际航运的活动,并应在各自法律和法规规定的范围内,保持和发展缔约双方海运主管当局之间的合作。 第四条 一、缔约双方对本协定第一条第二款所指的船舶,在进出其港口,系泊、移泊、装卸,缴纳港口规费,包括船舶吨税,和港口使费(如与所提供的服务相对应),以及提供海上和港口服务方面,给予不低于第三国船舶享有的待遇。 二、本条第一款各项规定不包括缔约任何一方按照地区间协定给予该协定成员国的特殊优惠或豁免待遇。 第五条 缔约双方应采取必要措施,便利和加快海运、船舶进出港口以及装卸、堆存、引水和拖拽作业,避免船舶不必要的延误,并尽可能加快办理和简化海关手续以及其他港口手续。 第六条 一、本协定的规定不适用于沿海运输。 二、缔约一方船舶为了卸下从国外进口的货物或装载出口国外的货物,而在缔约另一方的港口间航行时,不作为沿海运输。旅客运输亦同。 第七条 一、缔约双方相互承认和接受缔约另一方船舶持有的由船旗国主管当局正式颁发的船舶登记证书。 二、缔约任何一方承认和接受缔约另一方主管当局为其船舶正式颁发的国际吨位证书和其他船舶文件。持有本款提及证书的船舶在缔约另一方港口无需重新丈量。 所有相关的港口规费和使费应以上述证书为依据计算和征收。 第八条 一、缔约任何一方承认缔约另一方主管当局为其船员颁发的身份证件: 中国船员的身份证件为“中华人民共和国海员证”; 秘鲁船员的身份证件为“秘鲁共和国海员证”。 二、在缔约一方登记的船舶上工作,但不是该国公民的船员以及在按照本协定租用或经营的悬挂第三国国旗船舶上工作的船员,应持有符合现行国际公约的并被承认和有效的海员身份证件。 第九条 一、缔约一方船舶在缔约另一方港口停泊期间,该船持有本协定第八条所指身份证件的船员仅需取得主管当局的上岸许可即可以上岸并在港口所在的城镇临时逗留,毋需办理签证。 二、缔约一方持有本协定第八条所指身份证件的船员,因被遣返、登船任职或为缔约另一方可以接受的其他任何原因,经缔约另一方主管当局签证以后,可以以旅客身份在缔约另一方境内乘坐任何交通工具通行或过境。上述签证应在最短时间内发给,签证的有效期限由有权签发该签证的主管当局确定。 三、缔约一方的船员如需在缔约另一方境内就医,缔约另一方主管当局应准许其在就医所需要的时间内在其境内停留。 四、缔约双方应为缔约另一方的船长和其他船员与本国外交代表或领事官员的相互联系提供便利。 第十条 一、如果缔约一方船舶在缔约另一方港口、内水、领海或主权和管辖权支配下的海域遇难、触礁、搁浅或发生其他事故,缔约另一方应按照对缔约双方生效的国际公约对该船船员和旅客给予一切可能的救助并尽快通告遇难船舶的情况。如缔约另一方对遇难船舶和货物给予了有效的救助,则遇难船舶应按照缔约另一方的规定支付报酬或必要的费用。 二、从缔约一方遇难船上卸下或救出的货物、器材、给养和其他财物,如在缔约另一方境内使用或消费,应按照缔约另一方的国内法律和法规缴纳关税和其他捐税。 第十一条 经缔约另一方主管当局批准,缔约一方的航运企业在必要时可以在缔约另一方设立代表机构,并在该缔约方法律和法规规定的范围内从事航运活动。缔约双方应为本条提及的代表机构的设立提供便利。 第十二条 一、缔约任何一方的船舶和船员在缔约另一方港口、内水、领海或主权和管辖权支配下的海域停留期间,应遵守缔约另一方的法律和法规。 二、缔约双方同意在一般情况下不干涉缔约另一方船上的内部事务。但发生下列情况除外: (一)船上发生的违法行为的后果涉及到缔约另一方的领土或涉及到其国民的权利; (二)船上发生的违法行为危害了缔约另一方的社会公共秩序或安全; (三)船上发生的违法行为是针对不属于本船船员的人员; (四)缔约一方为取缔非法贩卖毒品或致幻物质而采取的措施;以及 (五)为制止其它一切非法行为所必需的行动。 三、缔约任何一方对在其港口、内水、领海或主权和管辖权支配下的海域停留的缔约另一方的船舶或在该船上采取强制性措施,应将所采取的措施通知缔约另一方的外交代表或领事官员,并为该代表或官员与该船联系提供方便。情况允许时,应事先通知。 四、本条第二款的规定不影响缔约各方根据本国的法律所拥有的监督权和调查权。 第十三条 缔约一方航运企业在缔约另一方境内获得的收入,应以可自由兑换的货币进行结算。该收入可以用于支付在缔约另一方境内发生的费用,也可以自由汇出。 第十四条 如对本协定的解释和执行产生争议,缔约双方的主管当局应通过协商解决。 第十五条 一、本协定经缔约双方各自完成本国法律程序后,通过外交途径相互通知,并自后一个通知发出之日起第六十天生效。有效期五年。 二、如在本协定期满前六个月,缔约任何一方未书面通知缔约另一方终止本协定,则本协定的有效期自动延长五年,并依此法顺延。 三、缔约任何一方可以终止本协定,但应至少提前六个月通过外交途径书面通知缔约另一方。本协定自该通知发出之日起六个月后终止。 本协定于一九九八年九月十四日在利马签订,一式两份,每份都用中文、西班牙文和英文写成,三种文本同等作准。如对本协定在解释上发生分歧,以英文本为准。 中华人民共和国政府 秘鲁共和国政府 代 表 代 表 黄镇东 卡瓦哈尔 (签字) (签字) AGREEMENT ON MARITIME TRANSPORT BETWEEN THE GOVERNMENT OF THEPEOPLE''S REPUBLIC OF CHINA AND THE GOVERNMENT OF THE REPUBLIC OF PERU Whole document The Government of the People''s Republic of China and the Government f the Republic of Peru, with the purpose of promoting friendly elations between both countries, developing their bilateral trade and trengthening their cooperation in the maritime field, based on the rinciples of equality and mutual benefit, have agreed as follows: RTICLE I For the purpose of this Agreement: a. "Contracting Parties" shall mean the Government of the People''s epublic of China and the Government of the Republic of Peru. b. "Vessel" shall mean any merchant ship registered in the territory f one Contracting Party and under the flag of that country, including erchant ships under the flag of a third country acceptable to the other ontracting Party and which are chartered or operated by shipping nterprises of one of the Contracting Parties, but precluding warships nd other non-commercial ships. c. "Crew member" shall mean the master or other person who during he voyage renders services on board a vessel of one of the Contracting arties, or on board a vessel of a third state flag chartered or perated by shipping enterprises of one of the Contracting Parties, ithin the scope of this Agreement, and who holds the identity document eferred to in Article VIII of this Agreement and whose name is included n the crew list of such vessel. d. "Shipping enterprise" shall mean any legal entity registered in he territory of one Contracting Party according to its legislation and uthorized to engage in international maritime transport services. e. "Cabotage" shall mean the maritime transport of one Contracting arty between the ports of its country according to its national egislation. RTICLE II a. Vessels of both Contracting Parties may sail from and to the ommercial ports of the two countries opened to foreign vessels onveying cargo and passengers between the two countries, or between the orts of either Contracting Party and a third country. b. The provisions in paragraph a. of this Article shall not affect he transport as mentioned in such paragraph by vessels of a third ountry. RTICLE III Both Contracting Parties shall, on the basis of developing mutual elations in the maritime field and adhering to the principles of fair ompetition and international shipping freedom, preclude any activities hich might hamper normal international navigation and shall maintain nd develop cooperation between the competent authorities of the ontracting Parties within their respective national laws and egulations. RTICLE IV a. Both Contracting Parties shall grant the vessels referred to in aragraph b. of Article I of this Agreement, a treatment not less avourable than that granted to vessels of a third country in ntering/leaving their ports, with regard to berthing, shifting, oading/unloading, paying, port dues, including tonnage dues, and port harges provided, however, that these correspond to services effectively endered, as well as in providing maritime and port services. b. The provisions in paragraph a. of this Article shall not include he special favourable treatment or exemption, if any, granted by either ontracting Party to member states in accordance with regional greements. RTICLE V Both Contracting Parties shall take all the necessary measures to acilitate and expedite maritime transport, port access of vessels as ell as cargo handling, storing, piloting and towing operations to avoid nnecessary delay of the vessels, and shall expedite and simplify as uch as possible customs procedures and other port formalities. RTICLE VI a. The provisions of this Agreement shall not apply to cabotage. b. When a vessel of one Contracting Party sails from one port of the ther Contracting Party to another for discharging imported cargo and/or isembarking passengers from abroad or loading export cargo and/or mbarking passengers for foreign countries, that shall not be regarded s cabotage. RTICLE VII a. Both Contracting Parties shall mutually acknowledge and accept he certificate of registration kept by vessels of the other Contracting arty duly issued by the competent authority of the flag state. b. Either Contracting Party shall acknowledge and accept the nternational tonnage certificate and other ship documents duly issued or its vessels by the competent authority of the other Contracting arty. Vessels holding the certificates specified in this paragraph hall not be remeasured at the port of the other Contracting Party. All related port dues and charges shall be calculated and levied on he basis of the above mentioned certificates. RTICLE VIII a. Either Contracting Party shall acknowledge the identity documents uly issued by the competent authority of the other Contracting Party or its crew members. The identity document of the Chinese crew is: Seaman''s Book of the eople''s Republic of China. The identity document of the Peruvian crew is: "Libreta de mbarco"(Seaman''s Book of the Republic of Peru). b. The crew on board the vessels registered in one of the ontracting Parties not being their nationals, and the crew on board the essels under a third state flag, chartered or operated under this greement, shall have acknowledged and valid seafarer identity documents n accordance with current international conventions. RTICLE IX a. During the stay of a vessel of one Contracting Party in a port of he other Contracting Party, the crew members of such vessel holding the dentity documents referred to in Article VIII of this Agreement may go shore for a temporary stay in the town where the port is located ithout processing visas. To such effect it will be only required the anding permission granted by the competent authority. b. Crew members of one Contracting Party holding the identity ocuments referred to in Article VIII of this Agreement may travel hrough and across the territory of the other Contracting Party as assengers using any means of transportation on account of their epatriation, joining a vessel to render services or any other reasons cceptable to the other Contracting Party once their visas have been uly issued by the competent authority of the other Contracting Party. he above mentioned visas shall be issued in the shortest possible time nd their term of validity shall be determined by th e competent uthority entitled to issue such visas. c. Crew members of one Contracting Party in need of medical reatment in the territory of the other Contracting Party shall be uthorized by the competent authority of such Contracting Party to emain in its territory for the necessary time for their treatment. d. Both Contracting Parties shall facilitate the ship''s master and ther crew members of the other Contracting Party to contact their iplomatic representatives or consular officers, or vice versa. RTICLE X a. Should a vessel of one Contracting Party be involved in an ccident, run aground, get stranded or encounter any other danger in the orts, internal waters, territorial sea or maritime areas within the overeignty and jurisdiction of the other Contracting Party, the other ontracting Party shall provide all possible rescue operations for the rew members, and passengers of such vessel, in accordance with nternational conventions in force for the Contracting Parties, and hall inform as soon as possible on the conditions of the vessel in istress. The vessel in distress shall pay the award or the necessary harges in accordance with the regulations of the other Contracting arty, in the event that such Contracting Party has provided the ffective salvage operation services to the vessel and its cargo. b. Cargo, equipment, provisions, and other property discharged or escued from the vessel in distress of one Contracting Party shall be ubjected to customs duties and other levies in accordance with the ational laws and regulations of the other Contracting Party when they re set aside for use or consumption in the territory of the other ontracting Party. RTICLE XI With the permission of the competent authority of the other ontracting Party, when necessary, shipping enterprises of one ontracting Party may establish their representative offices in the erritory of the other Contracting Party to engage in shipping ctivities as specified by the laws and regulations of such Contracting arty. Both Contracting Party shall facilitate the establishment of the epresentative offices as mentioned in this Article. RTICLE XII a. Vessels and crew members of either Contracting Party shall abide y the laws and regulations of the other Contracting Party during their tay in the ports, internal waters, territorial sea or maritime areas ithin the sovereignty and jurisdiction of the other Contracting Party. b. Both Contracting Parties agree not to interfere with internal ffairs on board the vessels of the other Contracting Party under normal onditions, except when: i. the consequence of the offence on board the vessel involves the erritory of the other Contracting Party, or involves the rights of its ationals; ii. the offence on board the vessel affects the public order, or ecurity of the other Contracting Party; iii. the offence on board the vessel is against individuals other han crew members of the vessel; iv. measures taken by one of the Contracting Parties are necessary o suppress the illicit drug trafficking or psychotropic substances; and v. actions needed to stop any other illegal acts. c. Either Contracting Party which adopts coercive measures against a essel of the other Contracting Party, or on board such vessel during ts stay in the ports, internal waters, territorial sea or maritime reas within the sovereignty and jurisdiction of the former Contracting arty, shall give notice of the adopted measures to the diplomatic epresentative, or consular officer of the other Contracting Party and hall facilitate that representative or officer to contact that vessel. n those cases, when the situation makes it possible, such notice may be iven in advance. d. The provisions of paragraph b. of this Article shall not affect he rights of supervision and investigation of each Contracting Party nder its law. RTICLE XIII Income earned by the shipping enterprises of one Contracting Party n the territory of the other Contracting Party shall be settled in reely convertible currency. Such income may be used to pay for expenses ncurred in the territory of the other Contracting Party or to be freely emitted. RTICLE XIV Should any controversy arise in the interpretation and mplementation of this Agreement, same shall be resolved through onsultations between the competent authorities of both Contracting arties. RTICLE XV a. This Agreement shall enter into force 60 days after the date of he last notification by which the Contracting Parties notify each other y diplomatic channels that all domestic legal procedures have been ompleted. This Agreement shall be in force for five years. b. This Agreement shall be renewed automatically for a successive erm of five years unless either Contracting Party decides not to renew t by giving notice in writing to the other Contracting Party six months rior to its expiration date. c. Either Contracting Party may terminate this Agreement by giving a ritten notice to the other Contracting Party through diplomatic hannels at least six months in advance. This Agreement shall be erminated six months after the date of such notice. Signed in Lima, on the fourteenth day of the month of September, in he year of 1998, in duplicate, in the Chinese, Spanish and English anguages, all the three texts being equally authentic.
